Sir, my wife and their family is filing a divorce case and they are saying that I am physically torturing and pledged golds given by her family. Q: Opinion about appointing two different lawyers for two different cases

I have appointed an advocate to fight for my child custody rights in family court.my estranged wife has approached for mutual consent divorce with a condition that the mutual divorce to be handled by another advocate other than the advocates appointed from both sides to fight child custody case. She has also filed a case against me and my parents under 498A . Shall I tell my present advocate about the divorce?Will avoiding him in the divorce case affects me in my child custody case adversely? I don’t want him to know about the move for mutual divorce as he along with the other advocate is trying to extend the case as long as possible. What shall I do?

Hallo..... It is not necessary to appoint the same counsel for your new case. But you have to finish your existing case before filing mutual divorce case. So both you and wife have to go for a written agreement about the child custody.



Q: Getting the dowry we have given for the marriage

My his says he needs divorce, but he won't return my ornaments unless I sign for the mutual divorce.how can I get it back. I'm a hindu.

Your husband and you can file a joint divorce petition before the Family court if both of you are willing...But for you, it would be better you can file an Original Petition before the family court for return of gold ornaments. Q: Husband Went Missing And Not Taking Care Of Wife Nd Kid

Hi, Am working in private sector. My husband was in dubai and he came to kerala on nov 3rd 2019, but from his office i came to know that he came to india on oct 10th. Once he came to kerala, he went missing/went to mumbai on dec21st after informing others that he dnt wish to continue relation wiith me. Yes... You can file a Maintenance case against your husband before the family court. Your child is eligible to get the maintenance from her father. File an MC petition at the earliest.. So that he will appear before the court and you will get the chance for mediation.
