previous company did not give complete salary what can be done

I have worked in a Company for 3 year.After 1st February 2016 my salary was 50000 rs month .I gave my resignation letter on 26th September 2016.After that I worked here for two months My last working day was 25th November 2016.I did not receive my salary for months of September,October and November. After 45 days(13th January 2017) of leaving the job they said that "because you did not complete full year in company we will calculate your pending amount with 40000 rs per month with effect from 1st February 2016". Please advise me what should I do now to get my hard earned money.

Please share the terms of your contract. This is unreasonable and you can serve a legal notice to your company unless you have agreed to any such provision of pay upon your non completion of one year. Also send a copy of your offer letter.

If nothing contrary is contained in your employment agreement with you employer you are entitled for Rs. 50,000 for all the months you have served. As you have already put your employer on two months' notice you are entitled for full payment.

Please take note of following -
1. You need to send them a legal notice asking for your Full and Final settlement and for your reliving as per the employment agreement which you have with yourself and your previous organization.
2. If they fails to respond to the notice or do not make any proper response to the notice then you can bring up a case in against them before the competent court of jurisdiction.

Hi, will glad to help you. You have many options to file a suit for recovery of money and also you can file a case for winding up. Is this company situated in Delhi? Because we have to see the jurisdiction also.
