What action can be taken against my in laws after filing 498a case

HINDU.I have been humiliated by my in laws n husband for the past 3 yrs for dowry. We had many settlements still the issue persists.I have been operated recently and then my husband humiliated me in front of his boss for no reason.He left home on July 3, 2016 . He informed my house owner that he has no relation with me anymore and that he would not pay the rent. I was all left deserted. He then filed a DIVORCE case on me on July 8 ,2016. I received the summons on Aug 12, 2016 asking me to attend court on Sep 15,2016. I have then filed a 498 a case and dowry case. Please tell me what to do.

HI,
you file application under section 12 of the DVC act also. first under this act you can apply for shelter and court will provide you to reside in a shared household under section 17 of the act. under section 18 of this act you will get protection from the court against your husband and your in laws. you can claim monetary relief under section 20 of this act. court will pass the interim orders to your husband to pay the maintenance to you till the pending of the case and you will get compensation relief orders from the court under section 22 of this act.
apart from this you file maintenance case under section 125 of CRPC.
in this case also you will get maintenance from your husband.
unless you will agree for divorce your husband can't do anything.
so, don't worry file cases and avail justice and start new life.

Madam,
it is unfortunate you have been disturbed this much. In this situation
1. In this instance issue , since you received the court summons , you attend and submit all your concerns to the court.
2.Always be tolerant for discussions and amicable solutions for family Disputes.Engage the elders and friends to talk to him to resolve the issue amicably
3. If failed, file a DV petition in the magistrate court against the husband and his family members
4. The magistrate may give the orders for protection, maintenance, separate residence, and the compensation
5. The husband will come to you for compromise due to the above case and 498
6. That time you can decide the settlement or the divorce or the mutual consent divorce
7. Engage a good lawyer familiar with the family disputes and family laws so that he handles the cases effectively

As you have received summons from the court, you have to appear before the court on that date either in person or through an Advocate. Since there are many legal procedures, we suggest u appoint an advocate to give a proper fight to divorce case. Your 498 case will be taken care by the prosecution as it is a police case. consult us for further legal steps.
