17-Aug-2023 (In Family Law)
My brother is married 10 years ago. He is having 4 childs(2 childs are staying with us and 2 are staying with her). My sister in law left home before 4 years ago and she was staying alone in pune.We tried to convey her but she didn't respond so, we admitted case in Latur court saying that either she has to come home or we need permission for brothers second marriage. Court has sent her notice continuously 2 years but she didn't respond so, court has dismissed this case. Now after 5 years she came to home and asking property shares. We are ready to accept her but she is not willing to stay with us but she wants property share. When we forced her to leave our home, then she crying and trying to act smart. Please let us know is there any law which will give justice to my brother. I'm staying out of india and because of my sister in law my family is suffering a lot. My parents and brother all are doing work in farm. They are simple and straight people . I want to stable there life.

Your brother's matter is complicated and has past litigation filed and dismissed. Before advising it is important to know what was filed in Latur and why was it dismissed. What justice is your brother looking for?How old are his children? Advisable for your brother to meet an advocate to discuss in detail. Your brother can approach the police for any help in case of harassment.

Your sister in-law left her husband and 2children and stayed away from you,now it seems that your brother has expired and hence she left the home along with two children

As per your query

If your brother doesn't wish to continue marital relationship with her he can file divorce petition against her. Simultaneously he can file application for custody of children. Unless your brother is having property in his name she cant claim share in it, but she has the right to claim maintenance.
