Conflicts between me and my husband how to proceed legally

19-Apr-2023 (In Family Law)
We got married on last December and with in 20 days he left me in india and back to uk by promising me that he will take me to uk on march. still now there is no update on my visa and also for 3 months there is no proper communication between us and now he is not at all calling me and his family members. he refused me to share his UK address details from the beginning itself, even his family members are also not aware of anything about him. the only thing we know is " he is in UK" that's it! . In this situation I took 5 sittings of post marriage counseling and they advised me to get divorce or make him to come india (now he wont come here), but I thought to give another chance to him by waiting for few more months. I have mentally depressed, I would like to continue my marriage life but my hubby behavior is just opposite to my thoughts. could you please let me know how to move this situation legally?.

Legally, there should be one year seperation period to file the divorce case and after that only you can file the divorce proceedings. My advice as fas as your issue is concern, you should wait for another 9 month. Because there is no negative remark from husband and the issue is only that he has not contact you and there is a chance that he may contact you in future. So just wait for some mote time and try to trace his contact details and email id. Even after the lapse of 1 year then you may proceed with the divorce proceedings.

Before taking steps for divorce, check his situation in UK. Without knowing any details about him and his job in UK you should not decide anything. Legally the divorce proceedings could be started after the completion of one year from date of marriage unless there is sufficent reasons.

How did you get to know about him? Did you get his contact from the internet? If there any broker or common friend who arranged the marriage? What is the reason you husband's parents are giving you? It is not possible that they dont know his whereabouts, otherwise they also must be acting in front of you. Just counselling will not help you in any way. You need to discuss your problem with a good Lawyer and take all the legal steps to solve your problem. Divorce is not the best alternative. You have to 1st find out what the real problem is and then only act accordingly. Kindly contact me for a detailed discussion, so that I can give you a clear advice and further guidance.
