Can i get an Agreement signed by wife to safe gaurd my married life

15-Dec-2023 (In Family Law)
Hi SIr, I m married & its being only 2yrs. one day Me and my wife had a small miss-understanding, their parents took her away. While leaving she said "I know how to leave without you". Her Parents said " I will not let my child with you". I never called them. She tried calling around end of 3rd month, I did not pick her call. After 3months they went directly police station with false complaint saying I had beaten her and sent her away from home. Me and My father went to station. And they tried to scare us by telling police to file FIR. We did not bother, Again after 3 months they came back saying to police station again saying, My daughter was harassed for salary. We now took them to Mediation centre. She is accepting mistake. She is saying "I did bcoz my parents n sister said". Now what can be done. She may be innocent, Bt Tomoro again if she goes with same way, My life will be ruined. Is there any way to in stopping this in future. like aggreement if you leave me, will file divorce.

Dear Sirs,

You cannot stop anyone for filing complaint or suit against you. However, you can record her previous acts and take an assurance that she will not do such mistakes again. It is just as a record that she has made a false complaints. Even if you take an agreement from her and if she commits a mistake, that will not be the ground for filing a divorce unless you establish sufficient grounds for filing divorce under the law.

An agreement signed after marriage or a 'postnuptial agreement' is not easily enforceable in Hindu law and also in most of the cases of marriage under other Indian law. Hence they are of little or no avail.

In case Agreements after marriage she can always state that she was coerced to sign it which could be a problem. As there is tension she may refuse to sign any agreement as she doesn't trust you. Only way is to file for conjugal rights in family court but she can file criminal complaints which cannot be stopped.
