Hi, As per the contents of your enquiry, it seems that you and your wife are sharing same house but are not in physical relations with each other. If that is the case, you can file for judicial separation wherein you will submit all the realities of your relationship with your wife. Second option you can choose is that you vacate the house of your mother so that your mother should not get involved in any case such as domestic violence etc. Third option for you is that, you contact us for preparing a police complaint against your wife and file the same with the local police station which will protect you in case any false case is filed against you or your mother by your wife. You can take my number from Lawrato.

She can not claim any right in the property of the mother though she may ask for residence on rent to be paid by you till divorce is granted. If you don't want divorce then don't file and in case she files for divorce you can defend the same. Besides you can now file for RCR.
