Procedure for contested divorce

11-Feb-2023 (In Divorce Law)
Please suggest me the way to get the divorce when the husband is not willing despite being the perpetrator. My parents are incapable of handling the situation. It has been more than six months that I am separated. He is narrow-minded, conservative and highly dominating. He has hampered my self-esteem by disregarding my decisions in day to day life and made my life miserable. These issues are something which they consider not as any torture. They want me to go back and stay with him but m not at all willing to stay with him, anymore. Please help me find a solution.

you can file for divorce on the grounds of cruelty. You will have to give incidents of cruelty in detail against your husband. In the same petition you can also ask for maintenance. alternatively you can also pursue a domestic violence petition under the provisions of DV act.

First of all file a complaint before the CAW cell of competent jurisdiction. You may also file a complaint under Domestic Violence Act. Go for the mediation at mediation center and even if the matter would not settle then file divorce petition.
