On what grounds can i file for divorce

hi I wanted to know on what terms can I file for divorce, we lived only 7months together after hindu marriage and from past 2 yrs am at my parents place. he is not agreeing for mutual consent and I don't want to get into the accusing: lots of problem compatibility, daily fights by mother in law asking me to get out of the house etc..on what clause can I file for divorce. I don't want to fight for compensation. can it be filed on ground of irretrievable breakdown of marriage.?

Since your husband don't want to go for mutual consent divorce, you need to go for contested divorce. You can file for divorce on the ground of Cruelty and harassment by husband and in laws. In mutual divorce a joint petition is prepared stating the facts when the marriage took place and from when the husband wife are living separately and similarly a brief reason in general that why they are not living together like differences etc--no personal facts are disclosed.
on the date the first motion both husband and wife need to sign in court the joint petition and then get a six months future date and once they present and sign on second date the decree of divorce is granted.

Alimony is not granted by court in mutual divorce its mutual as you and your wife decide.

Minimum time is six months
The divorce decree in mutual consent is not be challenged.
if the point regarding no future claims is added in the petition that will prevent any future claims by any party.

irretrievable breakdown of marriage is by itself no ground for filing of divorce under Hindu marriage act though in evidence it may be relevant to show that there is nothing left. You may file the divorce under any of the relevant grounds as mentioned under section 13 of the hindu marriage act, 1955 as they are applicable in your case.

You can file divorce under irretrievable breakdown of marriage or under cruelty. But it may take considerable time. However if you are not able to live with him at all then there is no other way than filing petition for Divorce. But based on the circumstances of the we have to build your case. So better consult a lawyer soon.
