In laws thrown me out of marital house can I file for maintenance case

I am expelled out of in laws house with a plan and left with a daughter in a rented house. husband has run away and not bearing any expenses. i do not earn. The rent agreement is between my husband and the landlord. will i have to leave that home? or can i continue staying in that home, file maintenance case against my husband, without paying rent? my daughter is to be admitted in school but i cant get her admitted because of the financial crisis. kindly help!

Hello you have right to claim the maintainence for you and your daughters upbringing. Please file case for that. Suggest you to get in touch with one of the lawyer for the same. Also you can ask for the free lawyer services by legal service authority.

You can file a complaint against your husband and in-laws in CAW cell. Secondly, a petition under Domestic Violence Act for protection, accimmodation and maintenance for you n your child. Thirdly a pettion under section 125 CrPC can also be filed for maintenance from husband

You must immediately file for maintenance for you as well as for your daughter. Also file for interim maintenance under section 24 of Hindu marriage act. Which will awarded to very soon as he appears before court.
