Husband asking for divorce without any alimony

We both r married for 2.8yrs now. For both of us its a second marriage. My husband use to control me for everything. Verbally abuse me if things r not according to him. Slowly he started accusing me of having affair with colleagues n my past life. I have son. Due to this I was into depression and he calls me as mad/psycho. Frm 1 yr we r living separately n he has not visited da baby too. Now he is asking for divorce on mutual consent without any alimony. I want him to attend couple counselling but he us not ready. I checked with psychiatrist, said he is suffering frm paranoid personality

Hello.
Your husband can not leave you like that.. You issue legal notice for restitution of conjugal rights by giving him 15 days time. Because you have a child whose responsibility both of you have to take..
In the meanwhile things May change and both of you join together for the shake if your child who should not suffer for no fault his..

what is your codification and what are you doing , what about your husband qualification and what is he doing , if you have one child , it is duty of the father to maintain the child , you can file maintenance case for your son and if your uneducated or unemployed you can also claim maintenance from the husband

Your question is not specific as to what you want. Anyway first you decide whether you need to continue your marital relationship with him or not. And thereafter you can approach jurisdictional family court seeking divorce on mutual consent. But you have got every right to claim your alimony amount.

If you want to remain married to him, you can file a case for Restitution of Conjugal Rights - a case in which you seek intervention of the Court to reunite you with your husband. If you want to separate from your husband but want alimony, you can claim it even in the Divorce case for mutual consent. Alimony or maintenance can be sought in Divorce by Mutual Consent cases as well. However, it is very important that you engage a lawyer of your choice, even if your husband engages a lawyer, to ensure that your legal rights and that of your son are not compromised.
