How to take divorce with my partner while having relation with another

i am married man i have 1 6month son & my married life is 2.5 years & i love other women she is also married & have 2 daughter we both love each other but our partner don't know about this please tell us what is the quickest way & safest way to take divorce with our partner & get married

Well, for starters, you need to file a divorce petition on the grounds of personal incompatibility and irreconciliable differences. You cannot say you are having an affair because that is illegal. The woman you claim to be in love with also has to file a divorce petition. This entire process could take a while, especially if your wife and your friends husband decide to fight it out. You should also speak with your wife and perhaps inform her of the situation.

Quickest way of dissolution of marriage is divorce by mutual consent. But for this purpose, you have to convince your wife for this purpose. If she refuses, then you can take divorce by filing a case for divorce before the family court. After the satisfaction of the court, the marriage between both of you will be dissolved by the court's order. Revert me. All the best.

The reasons informed by you is not one for which court can grant contested divorce as contested divorce is granted for specific grounds mentiond in section 13 (1) of Hindu Marriage Act.

Hence you can have mutual consent divorce, if your wife agrees for same under section 13B of Hindu Marriage Act. It will require two motions with 6 months gap in between.

Simplest way to get divorce is mutual consent so you both talk to your respective spouse for getting divorce with mutual consent. You they both are agreed to divorce you both then you both can get marriage after 6 month immediately after getting divorce.
