partner sold all company equipment and left for his hometown

I had given a cheque of rs 4 lacs to a friend to open a company account The company is registered in his name...I have only the bank deposit receipt as a proof...we closed the business due to financial loss and agreed to divide the money which we can get from the sale of office equipments...now that person has sold all d equipments and left for his hometown..can I sue him legally

yes, you can sue him legally in civil court.

however, whether you can file criminal case or not is not clear as it will require more details to verify if any criminal offence is made out by selling all the office equipment without informing and paying you..?

Hello sir,
As per this yes you can Sue him legally under law of the land and prescribed sections of the penal code and other laws. As you drew a cheque in his name so that is also sufficient proof and other proofs like your conversations about money. That can also add up to your points to make it a strong case.

yes you can file a criminal case of cheating under sec 420 of IPC against the person, the proceedings depends upon the onus of proof you have on you to prove your part in the business and if you have any documents to prove the monetary transaction!
