Question on Deed of partition. How can I apply for it

What is deed of partition. Can I apply for deed of partition if my dad's land is in my brother name now?

1. Whether the land is self acquired property of your father or it is ancestral property?
2. Whether your father wrote a will?
3. Whether you have applied for succession certificate?

Deed of partition is a deed which divides and distributes the ancestral property / joint property among co-parcenars that's to be registered. Partition in India is done based on the personal laws. Suppose If u r a Hindu, the partition is done with respect to Hindu succession act. In your case I don't know ur religion or if the property is ancestral or if it's a gift from ur father to ur brother or the source for acquiring the said property. You need to prove your claim.
