Property construction dispute what to do

After my Grand Father’s death, His house “Constructed portion & empty portion” was equally divided land area wise in 3 portions in his 3 sons. My Father got 1/3 portion which was empty land. 1 brother of my father got constructed portion while 1 brother got partially constructed portion. Each brother has donated part of their land for “Gali”. Now one of the brothers of my father is hindering us to open gate & construct a drainage saying that “Gali” belongs to theirs and you cannot use this “Gali”. He uses abusive language when we try for construction of drainage. Kindly suggest legal advice in the matter. I wish to open a gate in the “Gali” and construct a drainage in the “Gali”.

no one can force you from not using the gali as it has been donated and is for public use now. Secondly it is your discretion to construct the gate anywhere you want in your portion and your brother cannot dictate his terms over construction on your portion of land

When you have all the papers and you have the possession of the property, and the only matter of concern is Gali.
Then construct the gate and use it if anyone obstruct then complain to police and if he denies then file complain case in court.
