Partition Suit against ancestral property

12-Jun-2023 (In Civil Law)
I am from a Hindu family. We are having a house (purchased by my great grandfather & still legally undivided), ground floor of which is being used for business by one of our family member. If we filed a partition suit, is it possible to demand to stop the use of ground floor for business till the court has declears his final decision & if yes then under which circumstances court will accept this demand.

1) issue legal notice to your cousin for partition of the property .

2) if he refuses file suit for partition of property by meets and bound along with an application under order 39 rule 1 and 2.

3) you are entitled to sell your share even now but you would have to offer your cousin first right to purchase the property .

4) best is to enter into deed of family settlement / parttition so that you dont have to go to court
