Owner not ready to change water tank how to deal with it

I m the owner of a top floor builder flat with terrace rights. The builder fixed 500 ltr water tank on the roof and now the owner of first floor wants to replace tank with 1000 ltr capacity for which I am not agree.. Can he do so legally ? Or do I have any legal rights to stop him from doing so ? Will it not affect the structure load of the building ?
