Husband lying about pancard in court, can I file RTI to get details

As i know my husband pancard no my lawyer forcing him to submit his pancard no in court bt my husband refuse it n said he is nt having any pancard.He is lying abt this. as i m his wife so with help of RTI cn i get his pan card details like INR n other documents it is legal?If it is legal then hw to write application to RTI Plz tell.if it is illegl then hw cn i proof in court my husbans is pancard holder n pay incometax.hindu by law

Yes you can file for RTI and ask for the Pan details of your husband. but with obtaining pan details you would not be able to get his income. for that you need to ask the court to direct him to file income affidavit as per Kusum Sharma Judgment.

RTI is not meant for obtaining personal information such as PAN card but you can definitely file an application in the court for summoning details of Income Tax Return of your husband from the Income Tax Department. In case your husband is lying about the PAN card in the Court he may be prosecuted for perjury under section 193 of the IPC.
