Can legal heirs of a deceased govt employee retain the govt quarter

My father was a police sub inspector. He died in a motor accident while he was on duty.After the death of my father we kept occupying the government residence. After some time we received a notice from ssp jhansi to vacant the residence. We chalenged it in the Allahabad high court. Court gave us stay on that notice and gave a finding that the family of a deceased police officer who dies while performing his duty is entitled to occupy a government residence till the date of the retirement of deceased police officer which in case of my father is dec 2019. Now on 4 dec 2016 my mother has passed away. Will the same stayl be applicable now in our case being a leagal heirs of her ??

Being a successor you may claim for the govt. post from the state government and if not followed by the state authority then you can ask your advocate for a suitable appeal to the specific relief.
If you feel my response is appropriate then may consult as well.

Yes family means wife and childrens not only wife so your stay has been applicable on till December 2019 .That's acctuel retirement date not before because high court order binding to police so he don't do anything

Dear Sir,
As of now the High Court order is in your favour so do not attempt re-agitating this issue and enjoy the possession. Typically if you are a dependent then you are eligible else you will have difficulty.

The question is whether you are dependent on the deceased .If your are a dependent and unmarried you can stay till the date of retirement. the moment you marry your right to reside ceases.Hence the stay passed by the Honorable court will continue in case you are dependent on the deceased at the time of death.if you are not dependent on the deceased your right to reside will end and you will have to vacate the premises.
