Where one can file case for cheque bounce matter

Is it mandatory that a cheque bounce case will be filed near the bank home branch where cheque bounced irrespective of the fact where complainant or accused reside or any other facts ?

People can now file cheque bounce cases at the place where the cheque is presented for clearance and not at the place of issue, as per the new law which got President Pranab Mukherjee's assent recently.
The Negotiable Instruments (Amendment) Act, 2015 has received the President's nod on Saturday, official sources said today.
There are an estimated 18 lakh cheque bounce cases across the country, of which about 38,000 are pending in High Courts. Some litigants have to travel to different places from where the cheques were issued and not honoured.
The legislation provides that cases of bouncing of cheques can be filed only in a court in whose jurisdiction the bank branch of the payee (person who receives the cheque) lies. It will also result in fast prosecution of offenders.

It is a jurisfictional thing where to file a case you cam file it where the cheque bounce or where the accused bank is .

Or you cam also make the jurisdiction where you presented thr cheque for enchashment

No the jurisdiction for filimg a cheque bounce case arises where the cause of action took place it does not have to be filed where the home branch of the bank is. It was change by an amendment. I think this should solve your issue.

Please note that the petition under section 138 of Negotiable Instrument Act for cheque bouncing matter would be filed as per the jurisdiction of the Court for the branch of the Bank where the cheque was deposited.

As per the latest amendment in NI Act, 1881 w.e.f 15.06.2015 cheque bounce cases can be file within the jurisdiction of court where the home branch of bank of the complainant is situated. It is mandatory to file the cases u/s 138 NI Act.
