If that is the case you can file a criminal case against the person who has to give the amount to you. You can also file a civil case for recovery of amount against him
. You can file two cases against him.

Hello,

If the person is not giving another cheque to realize the amount, send a legal notice to him through a lawyer demanding him to settle the amount, thereafter, file a money recovery suit against him in the jurisdictional senior civil court by paying court fee.

Hi,
If the cheque is returned unpaid by the bank on the ground that the signature of the drawer on the cheque differs from his specimen signature on record of the bank, a case of dishonour of cheque punishable under Section 138 may be made out if other ingredients of the offence are satisfied. Dear Client,
You should present cheque in your bank account. If the cheque returns for reason signature not matching, then you must issue a legal notice through an expert advocate and file a criminal case under Section : 420 of Indian Penal Case for cheating you. You must also file a civil suit for recovery of promissory note amount along with interest and legal expenses if he has any properties. If he has no properties, then you must file only Criminal Case against him for cheating you. Engage an expert advocate for doing necessary legal work.
