sir/mam i have married last year and i have one baby 3 months.. my husband is torturing me for more money.. this is senond time .. first time i have put 498a case .. he comprimised.. but agian he started doing the same.. and i went police station an dhusband saying he dont want me any more.. i msged him for being good but he us not replying and he said he want to settle using money. please suggest how to proceed.. hindu religion

Even if you have lodged a complaint earlier, you can lodge a compliant now also. If at all your husband doesn't want you, let him go to court for the relief he wants. mean while you can go ahead with the 498 A and Dowry prohibition act .



Q: Procedure to file for divorce and child custody

Hi, I've been married for 4 years and since beginning itself there have been problems.we are hindu. My husband is very abusive both physically and verbally. Even on trivial issues he abuses me , my family. If I revert he uses physical violence. Earlier he didn't bear household expenses but for the last 2 years on much follow up he is now contributing to it. I'm a working lady and hv a 1.5 year old son. With him also his behavior depends on his mood. Can I get a divorce? What are the chances of my getting custody of son. My husband in general has a very short temper and has had public spats.

If you want to get back your child first give complaint in your local police station and if you want divorce you can file the petition in the court for Divorce with the issues you are facing with your husband.



Q: Validity of foreign judgment regarding divorce in India

My son got married in Hyderabad under Hindu Marriage Act. The married couple moved over and settled down in United Kingdom. Both of them hold valid Indian Passports.They recently got their marriage revoked in UK court and my son got issued a decree absolute. May I please know whether the divorce decree issued by UK court is valid in India also and whether any other formalities need to be completed in India also for the purpose of remarriage of my son.

As your son and daughter in law are still citizens of India and got married under Hindu Marriage Act, they have to obtain the decree of divorce from Indian Courts even though they obtained divorce in UK.

Your husband presence is not required to withdraw the 498 case. You can withdraw on your own . In lok adalat you can do it.

In case of a matrimonial dispute over maintenance, if the husband is not disclosing his yearly income, what recourse do we have. The husband was in private job upto recent past but claiming that presently he is unemployed.

If your husband is not disclosing his financial status, send a letter to the concern accounts officer or the head of the company explaining the issues and request to issue salary or other income from the company to your husband and also state that, the information given by them will be filed before the court.
