Q: What happens when in mutual divorce in second motion one person is not coming for sign ?

We have filed a mutual divorce petition six months ago now my wife not coming for second motion wantedly to harrass me . Should I alone attend second motion will it be helpful to me ?

She must attend for the second session also. If in the second session if your wife will not come to court, judge will not pass orders. If she will it come to court, you have amend the petition into contesting case.

Q: Taken money gave cheque with wrong signature on cheque what to do now

I given amount to person twelve lakhs and taken promissory note and cheque. I submit to bank they are saying wrong sign on cheque. i ask the person to give other with matching he refusing to give. what to do?

If that is the case you can file a criminal case against the person who has to give the amount to you. You can also file a civil case for recovery of amount against him . You can file two cases against him.

Q: Can i file a complaint against my father for abusing my mother ?

My father has been physically, emotionally, verbally, economically abusing my mother from the past 30 years. He restricted her to contact my maternal side. He has no job and from the past 30 years my mother has been working as a Staff Nurse in a Government hospital and has been the bread earner of our family. He restricts her to use her own earnings on her will. He drinks a lot and abuses my mother every time. She has been through every type of torture from slaps to beaten and broke her head by an iron rod, she has injuries all over her body. As we are three daughters my mother held back, thinking about our future and career. We have been suffering since years but kept quiet. Now we summoned up our courage and want to speak out because she might end up dying at this rate. Could you please help me to protect my mother. can i file a case against my father ? my marriage was soleminized 7months ago unfer hindu marriage act marriage was not consummated and from 6months we are staying separately. both of our families tried to reconcile but every attempt failed and both familes decided to go for mutual divorce and we hsve discussed about compensation and wrote a mutual divorce agrement form and we are planing to file a case by the end of this month. can i apply for divorce before 1 year ,so with in how many months first hearing will be called and with in how many months can i get divorce please explain in detail.

Sir We married in 2005, from starting inwards problems 2children are there. In 2012 she finally planned and escaped from house vacated with all furniture and gone their house and called me not come to her. Till now we trying but she is not acceptable to be with me or give divorce. I'm suffering a lot no sex life. It shown on my health and resigned my job 3years back. What exactly you want you have not stated, whether you are looking for divorce or you want your wife to join you. If you want your wife to come back and join with you, you file Restitution of Conjugal Rights Petition or if you want to give divorce, file divorce petition.
