my case in pending from one court to another

dear sir/mam, i had filled cheque bounce case against someone at my native place..later supreme court orders that cheque bounce case will be presented where cheque was issued(home back branch)..hence the case transferred at the place from where the cheque was issued..later again decision came as case will be presented where cheque was presented...again that case was presented at my native place..but now court is talking that all the papers they have not received from another court...it is already more than 11 months....what to do..please guide....i am really confused wheather i will get justice or not....please help ...please

I could understand your concern but after reviewing your case, it seems that you have not filed an application before trial court to withdraw and return the documents to file in the court having jurisdiction in accordance to Section 142(2) of the NI (Amendment) Act, 2015. Kindly note, trail court has no power to transfer petition, it is only SC that can do so. I will suggest avoid transfer petition and simply file application of withdraw to get the trial proceeding in correct jurisdiction.

Sir, present cheque bounced case is filed at only complainent bank is situated i.e. juridiction is only in the court where complainant bank is situated, know u can file application for call complete record from another court ,rest on VI's a vise
