Full payment maid still he presented the last cheque in the back

03-Feb-2023 (In Cheque Bounce Law)

I owed a man 2 lakh 45 thousand, infact I never took this amount from him. He was threatening us , so we had to give it in writing that we will pay every month 20 thousand. The first amount was paid in 2014 December. He took 13 chs saying that he will withdraw only 17,000 and not to mention the amount in the chq. My husband signed 13 chqs , wrote the name of the payee. That's it! Finally in January 2016 we paid him all the money and 1 chqs was with him.We called the bank and cancelled the same.To our horror, he submitted the same chq yesterday for 13,000 .The chq was returned as stp payment. Can we file cheque bounce case

A cheque bouncing case is filed by the person (drawee) on whom the cheque bounced and not vice versa. It is unlikely that for a small amount of Rs.13000/- the drawee will file a cheque bouncing case. If he does so, he will first have to send a statutory notice, which you will receive.

If no dues were pending then the case u/s 138 even if filed can be defended successfully by the accused and can get acquitted. You can meet me personally if possible (consultation chgs rs 300/- only) with all the documents and narrate full facts of your case, so that i can give you exact advise.
