What to do in a cheque bounce case?

I took a personal loan 3 yrs back of 60 thousand out of which i have paid around 50 thousand after that i got ill and was on bed for around 9mnths could't pay the rest amnt. left amnt was approx 12 thousand. they charge me with penalties and put my security cheque of 42 thousand in my bank which got dishonored. now they put a cheque bouncing case under section 138 on me but i don't have money to pay not even having money to pay to lawyer. the case is in mutation. what should i do now without money ?

Hello client.
In your question ur trapped now without the lawyer you can not do anything.only a good lawyer can help you out and is able to get rid of all your issues as you have mentioned in your question you need a lawyer.thanks

You may contact the state legal services authority for free legal help. Once they review the documents, they would be able to advise you. Why was the cheque for 42 thousand produced when the total due was less than that?

Ok in mediation justify your ill ness with the relevant papers of Doctors etc. Secondly, during mediation you don't need a lawyer, you can pursue it yourself, in 138 matters you always get a opportunity for mediation. Now since the amount was 12 thousand, you should request and argue that you have a legitimate reason for default and therefore the bank in mediation should waive off the interest, penalty cost. If you can settle the disport by paying 15-20 thousand pay that and relax. Then the 138 matter will be withdrawn by the bank.
