Questions Answered by Advocate Joydeep Nath

Q: Is it necessary to give blank cheque for loan ?

I took a loan from HDB bank, the bank officials asked for 10 blank cheques for ECS as amount was 200000.I gave the cheques after signing. So can they mis utilise the same or can draw prosecution on me, or it is a normal banking practice? why blank cheque required for loan ?

Advocate Joydeep Nath answered
This, I understand, is a typical bank procedure. If the ECS installment payment is unhindered, they may not use the cheques. However, in case there is a default in repayment, they may use the cheques to recover the dues and in the event the cheques, bounce, they can sue you under Negotiable Instruments Act besides suing for recovery for money. However, if the loan is cleared in due course without any hassle, you can always demand the cheques back from the bank. Hope you have kept photocopies of the cheques for your record.

Q: ATM dispensed less cash yet status showed transaction completed

On 4th August, 2018 I had visited an ATM of to withdraw money. The amount I entered for withdrawal was Rs.11,500/-. From the ATM I got a total amount of Rs.6000/- only. The denomination of the currency which was obtained from the ATM was: Rs.500x12 = Rs.6000/-. The ATM display screen at the time showed "Transaction complete". I have tried all complaints procedure and bank have rejected the claim. What to do now?

You can try complaining to the cyber cell of the local police. You may also approach the police for a proper investigation. Another option is the banking ombudsman which looks into service deficiencies on part of the banks.

Q: Republishing edited version of book published in 1962 in same name

My father wrote book in 1962 published by Oxford University Press India. Can I republish an edited version of this book in his name.

Advocate Joydeep Nath answered
Yes certainly. If the the copyright of the book still persists in your father, then you may need to take his written permission. Also, what arrangement did his publisher have with him? In case of a subsisting copyright, you may need NOC from both the publisher and/or the author. If copyright has expired, then you may produce a new edkited work in a fresh presentation with due credit to the author.
