Recovery of Money in Investment Case

03-Jul-2024 (In Recovery Law)
I had invested (trading deal) with a proprietary company registered in Kolhapur, Maharashtra. We have a contract and I have an open dated cheque from him. He has been delaying payment for a few days now and I would like to send a legal notice and proceed further. The proprietorship firm is registered in Kohlapur and the individual is based in Mumbai. Since the individual is based in Maharashtra, is it advisable to hire a local lawyer there to proceed?

If the other side has been delaying in repayment, we can send a legal notice. More so if cheque is issued, you can present the same in bank branch at your place and can also initiate legal recourse within that jurisdiction only. It is not mandatory to file a case where the defaulter is residing as he can escape to some other city as well. For any further assistance feel free to contact. Thanks

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

In the situation where you have invested in a trading deal with a proprietorship firm registered in Kolhapur, Maharashtra, and the individual proprietor is based in Mumbai, it's crucial to handle the matter with a structured legal approach to ensure your investment is protected and you receive the due payment. Here is a detailed course of action you should consider: Legal Framework and Jurisdiction Given that the proprietorship firm is registered in Kolhapur and the individual is based in Mumbai, the legal jurisdiction could involve both locations. Maharashtra's state laws and procedures will apply, and it's advantageous to have legal representation familiar with both Kolhapur and Mumbai courts. Sending a Legal Notice The first step is to send a formal legal notice to the proprietorship firm and the individual proprietor. A legal notice serves as a formal demand for payment and a warning that you may initiate legal proceedings if the payment is not made. The notice should include: Details of the agreement and the amount due. A reference to the open-dated cheque provided. A clear demand for the payment within a specified period (usually 15-30 days). A statement indicating that failure to pay will result in legal action.
