Case of Cheque Bounce under 138 of the N. I. Act

10-Jun-2024 (In Recovery Law)
Hello, A case has been filed on me by a bank for nonpayment of their loan. I was a very old customer of the bank and paid my EMIs on regular basis for many years even during pandemic. However after 2021 my situation changed as wasn't having any job for 2-3 years and therefore couldn't pay the balance EMI of personal loan. The bank had filed the case on 2022 and I got to know by a summon this year that I have to appear through online app on a date in July. Kindly advise what path shall I take?

You need to collect details of your all emi payment done by you, appear before the court on a fixed date , prepare your defence. if amount is very less than prefer to settlement, the process is very simple to defend the case ,you need not work.

You need to appear before the court and also submit your written statement and in that only you can write down your grievances for not being able to give the amount and also mention that you were very much regular before this time. And if there is scope of settlement then you can always serve the bank a legal notice regarding the settlement.

You would require to appear on the next date through virtual mode and assuming the matter pending since 2022 then there can be warrant issued against you. You need to furnish bail bond and contest the case depending upon the facts of your matter. Feel free to contact Thanks

We have to appear physically and we have to obtain bail from Court otherwise, the Court can issue warrants against you and thereafter, we need to strategise for defending your case. Therefore, in this regard, we have to formulate an appropriate approach for redressal of your grievances.
