Validity of land related notary agreement

Dear Sir, My father made sale agreement against an advance payment of Rs. 2.5 lac in the year 2010, but the deal was not completed from the buyers side. We asked the buyer to take away the advance money but he did not take it. Now in 2019 he is insisting to return the advance with interest or property against it. I need to know the validity of such agreement if the deal was not completed after so many years.

Which kind of agreement entered into between your father and buyer.If it was agreement to sell.And if period and conditions for performance of agreement were mentioned in that agreement.Then if that period lapsed there is no liability shall arise out of that agreement.

1. Did you enter into an Mou?
2. Was the mou notarized?
3. Was any such condition mentioned?
4. Was forfeiture of amount mentioned?
