Sister took care of property, but brother transferred it in his name

28-Jan-2023 (In Property Law)
House in a residential area from past 29years aprox. But it is still registered in agticultural land (khatauni ) on the name of mother. Their are 3 heirs - 1 male (A) and 2 females (X and Y) . Father used to live alone on this house as mother died before . And all three heirs got married but during his oldage X daughter cares for him - cleaning , financially, constructed and maintained the house from her own salary too. Now its being 29 years aprox. Since father died & She used to live happily with her family. But from recent years Some times A used to visit her( like relatives vaccation gettogether) and put some boxes of him in this house (as told he doesnt have much place to put these extra goods on his (A) rented house on another city but own some flats too in another city N now changed name from mother to his name only in khatauni n pressurised to leave this home but X used to live on this house and pays all taxes n bills. What to do from the behalf of X to remain on this house?

Daughter's name cannot be deleted like this. You have to file a case through advocate with the revenue authorities and your name will be added. Share in ancestral property cannot be denied to the children.

Why don't you setup a consultation with us. We have dealt with many matters of this nature and writing out a response will not do justice to the advice doled out and neither is it the best means to receive advice in such matters.

If there is no will, X can file declaratory suit. X needs to know how his name got registered at Khatauni, if he informedd authorities about the sisters or not or he got the same done with forgery. X needs to do proper foot work, collect all the documents and then file a declaratory suit.
