Sale of father's property without consent of married daughter

My name is S a hindu married woman. we are 4 daughters of our father. 13years back my father has baught a residential flat in his own name in M city. now he is selling that flat with consent of my mother and my 3 sisters except my consent and i have an objection with the selling as they are not allowing for my property shares so what can be the solution to stop the selling or how can i get my property shares?

Madamji u have to challange that sale deed in the court of law at civil side. Firstly u have to give a notice through advocate and then u have to challange that sale deed. Wheather ur 3 sister get any amount from that sale it is clearify from ur question so pls clear it and the do as adive u.

Since your father is alive and the property is bought by him in his own single name and with his own money, then he has all the right to sell the property without anyone’s consent. He can gift the money received out of sale of property to whomever he wishes to gift. Besides this if there are any other facts then need to review those facts and then can advise

Hello S,
As per the query raised by you, I believe the property is not self-occupied but it has been clearly purchased by your father under his name, here your father has the sole rights to do all the possible things which he may like to do with that property.
Apart from that, you will only be able to have an equal share in the property along with your mother and sisters in case of death and where he has not made any will, you will be entitled to equal shares in the property.

This is my response to you:
1. Your father can dispose of the property as per his wishes;
2. You can send a legal notice to claim share or money;
3. Maximum you can file a suit in the civil court;
4. Consult a local lawyer to show what documents you have as proof of your ownership claim.
