Purchase land from a private cooperative society but no road to plot

21-Oct-2023 (In Property Law)
I have purchased a plot in 2005 from Private cooperative society in a plotting scheme project with 20 ft internal roads in Bhubaneswar. After sale of plot, the owner of the society has sold 3 acres of land in the entrance of the project blocking the road to the plots. Later he has given an alternate road to the project. But within that project area one plot is there not belonging to the project and that plot owner constructed boundary obstructing the road. So around 20 plot owners out of 150 unable to get a road to the plot. Now owner of that society not listening . What to do ? will I file a consumer case ? Kindly advice.

I presume that the facility of providing internal roads must have been assured in the brochures of the said plotting scheme. In such an event, not making provisions for such amenities amounts to deficiency of service by the cooperative society. You definitely have the option of filing a consumer case. You can also initiate criminal proceedings given the fact that there is some element of cheating involved as can be inferred from your query.
