Property Papers Lost Of The Deceased.

My grandfather has passed away and I have lost his property papers (he is the only owner of the flat) , he has 2 Nominees and no legal heir and no will, how can we sell out the property. The flat is in Co-operative Housing Society.

First you register your name in society as nominee.and thereafter society can transfer flat on both nominees.and thereafter you can demand shares certificate from society.after that you can sell out flat.If society demands succession certificate from court.then file petition for succession certificate.

1. Your will become the legal heir then, being the class II legal heirs;
2. Similarly your siblings also have a claim;
3. State full facts firstly;
4. Then you can approach the registrar and try to obtain true copies of the original documents;
5. File a police complaint that the original documents are lost and not traceable;
6. Give advertisements in newspaper and invite claim;
7. Then you can go ahead with the sale;
8. Consult a local lawyer and take steps.
