Procedure to file the partition suit for division of property

17-Jul-2023 (In Property Law)
Hello, I belong to Hindu family. We are three real brothers. We have a registry of our house (in Lucknow) having names of all three. But the share is not divided. I am the middle brother and I am residing in New Delhi. The other two brothers are residing in Lucknow in that house. They are using our portion or I said the whole area by building additional rooms, toilets, and stairs etc. Now I want to sell the house but those two are not ready to sell it since they are satisfied with residing there. What can be done in this case and how can we take our share? The total area is 30’*60’ (ft). I am waiting for your instant reply. Thank you.

when you all bought that house then how much amount you was paid. If amount is one third of total consideration then you are owner of one third share. If they not giving your share then you file a partitions suit.
