Pecuniary eligibility for Jurisdiction in NCDRC

I have a dispute for commercial property with builder regarding compensation for delayed possession which he is not paying.The property value is above Rates 1 crore but compensation demanded is RS 55 lakhs.Kindly advice if I can file case in national commission.

Hi, as you may be aware NCDRC being a consumer forum, a commercial property case will be admissible so long as you can establish before the forum that the property is for self consumption purposes.

For determining whether any case will, when if the above criteria is satisfied, fulfills pecuniary jurisdiction or no, there is a methodology prescribed for determining that.

However, irt a property which has its value above 1 crore, the jurisdiction stands fulfilled.

That the property in dispute is of commercial nature so there will be hurdle in approaching the National Commission. That since the valuation of the property is more than crore so the national commission has jurisdiction.
