My wife expired without any will lefting behind one flat in a society of Ghaziabad, myself and 3 married daughters. Now I want the mutation done in my name. I got one certified family members list from SDM, Ghaziabad. Can it be done without legal heirs certificate and if required how much cost will be for the same. The 50% value of the flat as per her share in flat will be around Rs. 28,50,000/-. The other parteners for 50% in the flat are her 1 daughter and son in law who have taken loan from a bank. Loan is on 100% part of flat with the consent of my wife. How much cost will be for mutation in GDA. This flat was purchased from individual in October' 18 and the mutation is done in favour of my wife, daughter and son in law's name. My wife expired in Mar'19.

1. Legal heir/succession certificate will be required.

2. Accordingly on the basis of it, you can apply for mutation in your name alongwith your daughter and son in law.

3. then, Relinquish deed will be signed and executed through which you will be only owner. If they want to be part of it for 50 percent then go for succession certificate and accordingly upon court fees payment, it can be done.
