Is it possible to cancel settlement deed if person who wrote died

29-Jul-2023 (In Property Law)
My Grandmother has written Registered Settlement deed to me at 2008. I have one elder sister. And my grandmother has only one daughter. I am his only one son and i have one sister alone. She died before 3 months. Now with the help of my mother and father she is asking me the share. If i will not give share she is threatening me that he will send notice regarding share in that property. Is it possible to cancel the deed or get share form that property with the help of my mother?

If the property transferred to you by your grandmother was by executing a registered gift deed in your favor?

Did your grandmother possess marketable title at the time of transferring this property?

If yes for above two questions then neither your parents nor your sister can never challenge the same. You are the absolute owner of the property.

Her case is not maintainable in law.

A settlement deed can not be cancelled by the settlor or any other person. It can be cancelled only on obtaining the order of the court. If your family members proves that the settlement deed is made maliciously or by foul play then there is a chance of getting such a order from the court. Again for challenging the validity of the settlement deed proper evidence need to be submitted before the court proving their contention. I suggest you try out a amicable settlement as much as possible. If you feel the problem persist than you may decide the legal course of action available for recourse.
