12-Jun-2023 (In Property Law)
My mother's father had several properties including agricultural and commercial both. my mother was the single child of the family. my grandfather passed away in 2001, then my mother's relatives threatened my mother and father to leave all the property so that they can grab it all. none of the family member of ours tried to claim the property of my grandfather. As now my mother passed away in 2016, October 20. now I, her daughter, 19 years old want to claim my grandfather's property. there are total three members in my family, my younger brother,17 years old and my father. so how can anyone of us claim the property.

If the property is not sold by your grandfather, first of all get mutation of revenue records in your name from tehsildar as beneficiary for the same you have to prove your relationship with your grandfather and than file eviction suit before concerned Sub-divisional magistrate/tehsildar for eviction of unauthorized persons from your property.
or file a suit before civil judge there for successor certificate, change in revenue records and eviction of unauthorised possession of land.

You have every right to take your grandfathers property. Since your mother was his only child and she also passed away you can now claim the ownership of your ancestors property. The property will be transferred in name of you, your brother n your father. You can further contact me for any assistance.
