25-Oct-2023 (In Property Law)
In November 2019 we did registration on apartment and loan sanctioned in the month of Feb 2020. Now that apartment i bought from, have not paid house tax. They are not paying tax now. It is resell property/ apartment. 1) What legal action we take for that previous owner. 2) Can society provide NOC if the house tax is pending. So that we can take action against society. 3) I visited Nagarparishad, Nagarpalika they said from 2013 Tax was not paid to till date. 4) Can i get any waiver on interest or any amount.?

firstly it is the buyer's duty to make sure all taxes and bills are paid till the date of sale of the resale property. the burden to pay the taxes is in the owner. so the tax department would recover it from you as you are the owner. however, if the previous owner concealed the said fact and intentionally did not pay the taxes, you can take him to task by sending a legal notice and then filimg a case against him

In the event that property taxes have not been paid for an extended period of time, the local authority may start the process to sell the property in order to collect unpaid tax obligations. The property ownership rights can be lost.
