grant /issue of succession certificate to my sister in law

My brother died of a heart attack at the age of 47. He had stocks/securities worth ₹32 lakhs in Zerodha. My brother's wife (my sister-in-law) has requested the court to grant a succession certificate in her favor with respect to these stocks/securities. She has filed the application in Tis Hazari Court, New Delhi. The court has asked my mother to appear in court to show cause against the application. If you want to challenge the grant of succession certificate in favour of your sister in law, you will have to challenge it before the respective court in Tis Hazari. Your mother need not appear herself in person before the court, rather, you need to appoint a lawyer to appear on her behalf. Otherwise, the matter will be decided ex-parte. The question seems incomplete. Basically, in these situations the judge would send notices to all legal heirs seeking there no objection. If there is an objection it has to be told to the judge. What is the intention of the other legal heirs, that has to be discussed with your counsel.

If your brother has died intestate then in that case your mother has full right over the above stated amount being the Class 1 legal heir and with her NOC the Succession Certificate will not be granted. as per Hindu succession law your mother also has a share, so she has a right to claim her share in this. she should be present and file objection in this regard immediately to claim the share. court fees will be paid in ratio at the end of the case
