Father sold property in names of minor sons

Sir/Madam, My dad sold our property in 1997 which was willed by my grandmother to only grand sons ( Me & my brother), that time we were in school ( Minor) and we signed the document without the knowledge that the property belongs only to my brother and me, as per the buyers request my father, my sister have also signed for the sale of the property. but later when I came to know that their signatures were not required. As my sister was 10 yrs elder to us and was married at that time took advantage as we did not know any thing about deal she had managed to get around more than 75% of the sale money from my father. kindly advise if we can now file a case to get our share or at least some thing form the sale. As you informed in your problem that your grand mother executed a WILL in your and your brother favour, then both your self and your brother will become the owner of the property from the date of death of your grand mother and the said WILL come in to existence.

As you informed that you are minor and you have signed the paper. Being a minor if any transaction is took place or any consent you had given, for such act do not stand as per law.

Please see in which document you have signed. Moreover your sister or your any family member may become a administrator of the said property till both of you attain majority. But they wont have any absolute right to convey the property to any one in existence of the aforesaid WILL


Yes you can file a case by challenging the sale with the Original WILL and the Witness to the said WILL
