Sir, we have a property where the property hasn't partitioned with our family members, my other family members are using Electricity in same property. They aren't allow to take the new connection, because They don't want us to live in this place. That is our ancestral property. The Electricity board are asking for the No objection form signed, because they already falied to install the connection one time and we are unable to get the to signed from them. There are some rule/regulation/article/provisions so, that we can get the connection. Kindly guide...
Electricity connection being the an essential connection, the Hon'ble Supreme Court has held that such connection has to be provided even the unauthorized occupier. In your case if you can prove that you are in possession of your portion you are certainly entitled to electricity connection even if there is no NOC from other co sharer, moreover the electricity authorities are liable to set up the connection even after any objection is raised. You shall certainly get relief by filing a writ petition in Higb Court.
