Does Law of Adverse Possession applies in case of inherent

09-Jul-2023 (In Property Law)
My Father purchased a home on name of my grandmother in 1981. in 2003 my father and Uncle got separated on mutual understanding and we were allowed to stay in our home on name of my grandmother. My grandmother and Uncle with their family went to stay at our village. in 2003 may grandmother expressed her consent on paper(simple paper with no stamp or registration) to have no objection if property gets transferred on my father's name. since 2003 My father exclusively stays at above property. In 2008 my uncle residing at village died and in 2012 my grandmother died leaving a will behind for our joint family property - Land at village to transfer her share on name of my aunty. in will there is no explanation about above Residential property. And in 2016 our society committee transferred share certificate on my father’s name. Since 2003 till recent no one claimed ownership of this house and now my aunty has requested to society for her right on bases of being inherent of my uncle.

As the property was purchased by name of your grandmother and for the same property an documented evidence was also left by her in written in favour of your father willing to give it to your father; you don't have to be worried about it. It is crystal clear case. Moreover the share certificate is also transferred by your fathers name that means he has got the title. Your next step is depend upon what is response given to your aunty by your society.
