I want to sell my flat, which is in a cooperative housing society. Can the society object to the sale of my flat if I have paid all maintenance dues and have no outstanding payments? Are there any rules regarding the sale of a flat in a cooperative housing society, such as restrictions on selling to a person belonging to a scheduled caste? Can the society create hurdles or prevent the sale if they protest? Some members say that no owner has the right to sell their property without the society's permission. Is this true? Can a registered society sell its property? Kindly provide legal advice.

Advocate Mukund Kumar answered
No one can stop you from selling your property. Thogh you need to check article of association of your society specifically terms and conditions made for sale purchase of property. Any objection raised must be genuine and according to it. If it is not you can challenge it.

Q: How can I file a case for the division of property? I'm looking for guidance on how to file a proper

I have a question regarding filing a case in court for our share in the property. Do we need to send a legal notice first, or can we directly file a petition in the lower court? After filing a case for property share, can my brother, who lives in our mom's house (the subject of the case), start construction on that house without our permission? What are the steps on how to file a property case in court and how to file a case for property share?

Advocate Mukund Kumar answered
First of all you need to file a probate and get order from court that you have interest vested in your moms property(in case if your mom is no more). THENFile a partition suit in the court of relevant jurisdiction all together (legal interest holders in that entire property)in order to decide part of the share in that concerned property. If any person is not co-operating then court will summon him/her for that purpose. And about the construction - if any matter is pending before the court, you can raise objection.FOR DEEP & FURTHER CONSULTATION CONTACT ME THROUGH THE SERVICES OF THIS WEBSITE.However, it can be also done arranging family settlement - without going court.

My grandmother passed away without making a will, and the house is in her name. However, my brother and sister are not willing to give me my share. If I file a case for partition in court, how long does a property case typically take, and how long do property disputes generally take before a court order to sell the house is issued?

Advocate Mukund Kumar answered
Your grandmother died intestate. In that case all the successor has equal right over that property respectively their level of generation. So first you need to file a case questioning your right over it. It seems a crystal clear case as you have mentioned above. Proceed hopefully. You would have definitely good bucks in your hands.

Q: What should I do if my parents are forcing me to marry someone else, against my will?

I'm 20 years old and my parents are forcing me to marry someone else, despite my desire to focus on my career and pursue a job. They are emotionally blackmailing me into getting married soon. I need advice on how to handle this situation.

Advocate Mukund Kumar answered
First of all the right/legal age for marriage of any boy is 21 and for any girl is 18 - complete. 2nd thing is nobody can force you to get married or to marry any particular person. You are free at your will pertaining to the decision of you marriage. Though if anyone do, you can approach police or samaj kalyan kendra located in your city/area.Enjoy your freedom.

Q: Case Under Section 12 Of 498 A

My wife has file a case under section 12 of 498a in Vadodara, we are living separately for last one year, case in unsubstantiated and we have never lived in Vadodara can cases like this be filed anywhere in the country or is there a jurisdictional issue

Advocate Mukund Kumar answered
case can be filed in the city where you were spending your marriage life.case can be filed where you are living. case can be filed where she is livingyour query is hot complete one, you are just asking probability. it would better you contact a lawyer face to die and discuss the matter with him. otherwise there are hundreds of possibilities. that can be only assumed. the will give you only mental stress. and also be ready ti do some expense as consultation charge to lawyer to whom you are going to see. otherwise your case would be spoil.
