Daughter's right in the ancestral property as per Succession Act 2005

24-Mar-2023 (In Property Law)
My mother died on 1950 & my father died on 11/06/1986 before amendment of hindu succession Act 2005 leaving behind 3 sons & 4 daughters. All the dauthers are married before the death of my father. There are some agricultural lands absolutely in my father's name along with a dwelling house property in a land measuring 10 kathas at Nadia district of West Bengal. Now please tell me whether the daughters are eligible to claim any share in my father’s property now? I am hindu.

After the amendment of the Hindu Succession Act 1955, the married daughter is entitled to the share of the father's property. Since in your case your father demised before such amendment and your sisters were married before your father's demise, they won't get the share in the father's property. Regards. All the best

yes.. the daughters of the deceased can claim their shares in the agricultural lands as well as dwelling house properties because it is immaterial whether they are married or not to get the shares from their deceased parents..
