Clarifications on right of mother in maternal grandfather property

19-Dec-2023 (In Property Law)
My maternal grandfather has 12 bigha property, in which 6 bigha was gifted by his uncle. He has two children, one daughter (my mother) and one son who died leaving his wife and daughter. So, my grandfather has gifted 6 bigha as gift deed to his grand daughter. So, wether my mother can fight for whole property or 6 remaining 6 bigha left out?

Hello querist
The 6 bigha land which has been gifted to your maternal grandfather, your mother can't claim anything on it untill and unless you challenge the same gift deed.
With regard to other 6 bigha land, if it is ancestral property then your mother has 1/3rd share in the property in case your maternal grandmother is not alive. After the amendment in Hindu Succession Act, the woman has equal rights in the ancestral property.
