Buying Flat from Builder who developed Apartment JDA with owners

Dear team, I needed advise on one thing for buying flat, if all records are verified with lawyer can we buy with below exception; Builder has built 5 floors one extra then plan and also modified original structure. He has shown modified approval cum OC application which has been acknowledged by BBMP. He also says he will get approval pls oc and cc before registration else will refund me in full. Can we enter into agreement now for buying with above exception mentioned? Thanks
sir, i understood your question. legality of documents of the building is an important one. YOU said that structure of building is modified and the application is pending. He can not modify the structure unless obtain the permission of modification. As per law, if modified the structure before permission, the authority has no right to post sanction. It is not good to enter in to agreement without the owner obtain permission on modified structure. it is not good to hang the problem.
