Brother signature required to sell property but uncle selling w/o sign

02-Nov-2023 (In Property Law)
My brother is adopted by my uncle via registration when he was 10 yrs old. Now my brother is 38 yrs old. Apart from this we had registered a affidavit 2 years back that my uncle cannot sale any property without my brother signature. Problem is now my uncle is trying to sale the property without my brothers signature. Is this valid and what we need to do to stop this sale.

It depends upon the nature of your uncle's property. I mean to say if it is self acquired property then he can sell it without your brothers signature and if it is ancestral property then he cannot. That mere affidavit is not admissible in the court of law by the way. Lastly I could guide you more perfectly if you disclose the nature of the property.
