Will decision of criminal case affect civil case in the same matter

sir, Mere father ki bus accident se on the spot death ho gai thi. Isme 2 case file hue hai. Mact case and criminal case Kya hum criminal case pehle solve karva sakte hai? Kyoki mact case high court mai chla gaya hai and usme abhi time lagega Mera question hai agar criminal case ka decision pehle aa jata hai to mact case pe koi effect to nahi hoga?

Normally, the procedure adopted by the Courts is the case before the Motor Accidents Claims Tribunal (MACT) is decided first upon which the quantum of compensation or insurance is awarded to the claimant/ aggrieved party. Thereafter, the criminal case starts which goes through many stages i.e. which includes filing of chargesheet, arguments on charge, and then begins the trial. After these stages, the final arguments are done by both the parties and thereafter comes the final judgment which is the last stage of the fate of a criminal case.

The both are independent cases hence would not effect each other until and unless some evidences which are given simultaneously are against you.It is thus advisable not to worry and to give your best through yourself or your pleader.

Yes, it will not affect your Mact at all dear. As both the cases are different. So proceed accordingly. Trial court se kya order hue? Secondly what I think insurance company High court gai hogi. In such a situation as court to release the 50percent of the decreed amount in your favour. Get in touch if u wish over both the matter for advice and as well as court proceedings.

There will be limited effect as both the cases a slightly interlinked. In case in MACT your father must have got the compensation from district court then for what purpose the matter has been reached to HIgh court. Have you filed an appeal for enhancement of compensation or Insurance company has filed a case for reduction of compensation. I presume that criminal case is against accused and your father was a victim. U have not elucidated all the facts properly so i won't be able to answer everything related to the case. In short You can go for settlement in criminal case and it will have no bearing upon your civil case.
