Complete procedure for 304A, 279


13-Dec-2023 (In Motor Accident Law)
Have met with a accident and the opposite party unfortunately expired in the accident. Now i have a civil as well as criminal case going on in fron of the honorable court. Wanted to understand the further proceedings and expenses incurred in the whole proceedings. As my current lawyer is charging too high for no results.

If you subscribed insurance then insurance company will pay the compensation and regarding criminal case it might end in 6 months and generally ends in fine.
you are liable to pay a fine in the court.
Regarding expenses depends upon the lawyer and court. generally 10,000 is enough for this case

Actually for criminal proceedings you have to pay fine in concerned court and which was closed with in one hearing . And for civil proceedings in Motor accident cases insurance company will conduct the case ,if court orders to pay compensation to the victim , insurance company will pay the compensation.

the High Court in exercise of its inherent powers can quash criminal proceedings or FIR or complaint for offences under Cr.P.C. Second option is to expedite the trial. expedite means the case will be adjudicated as fastly as the Court could.
